Markitown

End User Licence Agreement

Last updated 21 October 2026

This End User Licence Agreement (“Agreement”) is between you, as the individual user or the entity you represent, and Gabhel Studios SL (“Gabhel”, “we”, “us”), with VAT identification number (NIF-IVA) ESB86731155 and address C/ Anabel Segura, 10, planta 3.ª, edificio F, Alcobendas, Madrid, Spain. It governs the licence to use Markitown for iPhone, iPad, Mac and Apple Vision Pro, including updates supplied under this Agreement.

Downloading, installing or using the app requires acceptance of the applicable licence. If you do not accept its terms, you must not use the app. The purchase terms presented by the App Store and your mandatory statutory rights remain unaffected in all cases.

1. Parties and relationship with Apple

This Agreement is between you and Gabhel Studios SL, not Apple Inc. or its subsidiaries (“Apple”). Gabhel is responsible for Markitown and its content. Apple has no obligation to provide maintenance or support for the app.

Use and acquisition through the App Store are also subject to the Usage Rules in the Apple Media Services Terms and Conditions. This Agreement does not permit use contrary to those rules or seek to replace the terms Apple presents to you for the transaction.

2. Grant and scope of the licence

We grant you a non-exclusive, non-transferable licence to install and use Markitown on Apple-branded products that you own or control, in accordance with this Agreement and Apple’s Usage Rules. The app is licensed, not sold; rights not expressly granted remain with their respective holders.

You may use Markitown with personal, educational or professional documents. The software licence does not in itself restrict commercial use of your own documents. Access by other accounts through Family Sharing or volume purchase programmes is subject to what Apple, the relevant purchase and its rules allow; this clause does not state that those options are enabled for any particular purchase.

3. Free reading and the full version of Markitown

Reading is free. The full version of Markitown is an optional, one-off, non-consumable in-app purchase that unlocks editing and export on compatible Apple devices using the same Apple Account. The full version is not a subscription: there are no recurring payments, and it includes lifetime updates at no additional charge for those updates.

The description and price presented by the App Store before you confirm the purchase determine what you acquire. The full version does not renew periodically, and you do not need to create a Markitown account. Restoration uses Apple’s purchase mechanisms.

Updates to the full version are provided without a further update charge. Installing each version requires a device and operating system compatible with that version; this commitment does not make an incompatible device compatible or alter the requirements specified for each release.

4. Payment, withdrawal and refunds

Apple processes payment and presents the price, currency, taxes and purchase terms. We do not process your card details directly. You can manage your purchase and request a refund through Apple’s channels, including reportaproblem.apple.com, without prejudice to any rights you may exercise against Gabhel.

If you are acting as a consumer, you retain any right of withdrawal provided by applicable law. In the European Union, the exception for the immediate supply of digital content only applies when the legal requirements are met, including your prior express consent and your acknowledgement that you lose that right where required by law. Downloading or using the app does not in itself constitute a general waiver of your rights.

If you need help with a purchase or a claim, email info@gabhel.com. App Store refund policies do not replace statutory guarantees of conformity.

5. Your documents and their ownership

Your documents remain ordinary files in the locations you choose. You retain control of their contents and are responsible for keeping your own backups.

You retain the rights you hold in the text, code, images and other elements of your documents. Using Markitown does not transfer their ownership to us or grant us a licence to publish or market them, or use them to train models. Opening or editing them does not send us their contents.

You are responsible for holding the necessary rights to the materials you use and for checking the result before publishing or sharing it. Third-party files, including those generated by AI tools, may contain errors or elements subject to their own licences.

6. Restrictions and uses permitted by law

You must not redistribute, rent, sell, sublicense or transfer the app beyond what Apple and applicable law permit; remove its ownership notices; circumvent purchase controls; or modify, decompile or reverse-engineer the software except where you have the right to do so.

These restrictions concern the app, not the copying, modification, export or distribution of your own documents. Nor do they prohibit acts permitted by mandatory law, including those relating to backups, observing and studying how the software works or interoperability, or rights granted by the licences of open-source components.

You must use Markitown lawfully and respect other people’s rights. Opening instructions, skills, AGENTS.md, plans or files used with AI agents is part of working with documents; this Agreement does not add a general ban on automating that work by lawful means.

7. Intellectual property in the app

Rights in Markitown’s code, interface, brand, graphics and documentation belong to Gabhel or their respective holders. The licence to use the app does not authorise you to appropriate those elements or present a modified version as an official release.

Third-party components retain their licences and notices. Where one of those licences grants you specific rights, this Agreement does not restrict them. Apple’s and other third parties’ trade marks belong to their respective holders, and mentioning them does not imply sponsorship.

8. Privacy

Markitown does not collect data or require an account. The privacy policy explains the absence of data collection in the app, the use of your chosen file locations and the handling of any voluntary correspondence you may send to support.

Accepting this Agreement does not constitute blanket consent to collect data or change those practices. Services you choose to use, such as iCloud Drive or other file providers, are also governed by their own terms.

9. Accessibility

Our accessibility commitment and the features available on each platform are described in the accessibility statement. You can report barriers or ask for help at info@gabhel.com.

The document review features help identify issues, and the full version’s export options include tagged PDF and semantic HTML. No automated review replaces checking the content you choose to publish or in itself certifies your documents.

10. Third-party files, resources and services

Files may include links, remote images or other third-party resources. Their availability, content and terms depend on their owners. Opening them may require a connection and generate a request to the destination service.

You must comply with applicable third-party terms when using those services, including your storage provider and data connection. This clause does not exclude any liability Gabhel has for Markitown under the law.

11. Updates and maintenance

We may provide fixes, improvements and compatibility and security updates. App updates are subject to this Agreement unless a different licence is presented for your acceptance in accordance with the law.

Technical requirements and features may vary between platforms and versions. We will fulfil applicable obligations relating to updates and conformity. This clause must not be interpreted as a right to withdraw a purchased feature arbitrarily or charge again for updates included in the full version.

12. Support and contact

Gabhel Studios SL is responsible for the maintenance and support of Markitown provided for in this Agreement or required by applicable law. Apple has no obligation to provide those services for Markitown.

For questions, issues, complaints or claims, email info@gabhel.com or write to Gabhel Studios SL at C/ Anabel Segura, 10, planta 3.ª, edificio F, Alcobendas, Madrid, Spain. Provide only the information and examples needed to understand the problem.

13. Warranties and conformity

If you are a consumer, you retain your statutory rights regarding the conformity of software and digital content, including, where applicable, having it brought into conformity, a price reduction or termination of the contract. These rights are not excluded because reading is free, because you purchase the full version through Apple or because you accept this Agreement.

Apart from express warranties and obligations that cannot lawfully be excluded, the app is provided “as is” and “as available”. There is no guarantee that every third-party document is free from errors, that all remote resources will remain available or that the software will work on systems that do not meet its requirements.

If the app fails to conform to an applicable warranty, you may notify Apple, which will refund the app’s purchase price in accordance with that warranty. To the maximum extent permitted by law, Apple will have no other warranty obligation in relation to Markitown; any other claims, losses, liabilities, damages, costs or expenses attributable to the failure will be Gabhel’s responsibility to the extent required by law.

14. Liability and claims

Gabhel, not Apple, is responsible for addressing claims relating to Markitown or its possession or use, including claims concerning product liability, failure to meet legal requirements, consumer protection or privacy.

Nothing in this Agreement excludes or limits liability that cannot lawfully be excluded or limited, mandatory consumer rights, or liability for wilful misconduct or gross negligence. No general financial cap is imposed that would reduce those rights.

If a third party claims that the app or its possession or use infringes intellectual property rights, Gabhel, not Apple, will be responsible for investigating, defending, settling and resolving that claim in accordance with applicable law.

15. Term and termination

The licence remains in force while you use the app in accordance with its terms. You may stop using it and remove it from your devices at any time, keeping your documents in their existing locations. Deleting the app does not in itself initiate a purchase refund.

A material breach of this Agreement may lead to termination to the extent permitted by law and with the applicable safeguards and opportunities to remedy the breach. This does not create a right to revoke a valid purchase merely for convenience. Termination does not transfer rights in your documents to Gabhel or extinguish statutory rights or claims that have already arisen.

16. Legal compliance and export

You must comply with the export rules and restrictions applicable to the app. You represent that you are not located in a country subject to a United States Government embargo or designated by that Government as a sponsor of terrorism, and that you are not on its lists of prohibited or restricted persons or entities.

These conditions apply to the extent required by the relevant distribution rules and without prejudice to any other applicable mandatory rules.

17. Apple as a third-party beneficiary

Both parties acknowledge that Apple and its subsidiaries are third-party beneficiaries of this Agreement. When you accept its terms, Apple will have the right to enforce this Agreement against you as a third-party beneficiary and will be deemed to have accepted that right.

18. Governing law and dispute resolution

This Agreement is governed by Spanish law, without depriving you, if you are acting as a consumer, of the protection afforded by the mandatory rules of your habitual place of residence. You retain the right to bring proceedings before the courts available to you under those rules.

Disputes will be referred to the courts with jurisdiction under applicable law. You may first send a complaint to info@gabhel.com, but doing so is not a condition for exercising your rights or accessing consumer authorities or the courts.

19. Entire Agreement

If any provision is invalid or unenforceable, the remaining provisions will remain in force to the extent legally possible. Failure to exercise a right immediately does not constitute a waiver of that right.

This Agreement governs the Markitown licence together with the applicable purchase terms and Apple rules. The privacy policy provides information about data processing and does not authorise data collection by contractual reference.

20. Changes to this Agreement

Changes will reflect changes to the app or the law and may not retrospectively deprive you of acquired rights. You will be informed of changes, and separate acceptance will be requested where legally necessary. Continued use alone does not constitute acceptance of a substantial reduction in your rights.

The last-updated date identifies this version. Translations must retain the same scope; no language clause may reduce the protection to which you are entitled as a consumer.
